I disagree; the goal is to provide an ultimatum that either 1) forces him to take responsibility for his actions or 2) results in termination of his sub-forum privileges.
If the ultimatum is not actually delivered to him, a third outcome is possible, in which he never sees this thread and loses his sub-forum privileges because of that.
In my opinion, the decision to terminate his sub-forum should be based on whether he is willing to take responsibility for his actions, not whether he happens to read GH this week.
Now, I agree that he should be reading this forum. Moreover, considering the extent of his transgressions, I think it would have been completely justified to kick him off the forum without any kind of review process. But, now that one is happening, he should be notified of it. If he is not, then the decision hinges on something that is secondary to the real issue at stake, as I have pointed out. And, it seems a bit disingenuous to me to not even inform him.
Also, part of him taking responsibility includes fulfilling all the outstanding orders to GH members. If his forum is deleted, GH loses the main leverage it had to help out its members in this regard. All this to say that his activity on the forum is crucial, but I disagree that it's the main issue at stake. The main issue is him taking responsibility and paying his debts. And the best way to bring that about is to make sure he knows about this thread.
Anyway, I am biased. Originative has good products and I think everyone would win if he would shape up. To me it's the best outcome.
But I will not interfere, and I will say no more on the matter.
