A perfect target for sleazy buyers! Come one come all!
« on: Sat, 03 January 2015, 10:56:10 »

Those who know me know that normally I loathe sleazy people.

But now I am posting this specifically to draw the attention of sleazy people. I know you’re out there and I know you are lurking and I know you guys have smurf accounts and want to scam somebody.

Well, rather than cause us legit geekhackers any trouble, here’s someone who’s practically asking to be scammed.

http://www.ebay.com/itm/Corsair-Vengeance-K70-wired-keyboard-Cherry-MX-Blue-Fair-condition-Used-/231441178452?pt=PCA_Mice_Trackballs&hash=item35e2f81f54

Look at his officious and totally unrealistic wording:

“IMPORTANT: I will not ship outside the USA, sell to users with low reputation,  or sell to users using eChecks.  Any user who decides to purchase anything from me can expect signature confirmation.  Each item is photographed with your username in the shot to prove the item is brand new and yours.  Those attempting to abuse eBay's policy can expect to have a claim filed against them if there is a fraudulent dispute, which you are expected to respond and appear in the State of Ohio.

ALSO: eBay/USPS shipping times are inaccurate and should not be used as a reference.  I have FIVE business days to ship any item out.”

I can’t help but ask, who are you kidding?

For one, he is selling something he admits is used. So his boilerplate ‘to prove the item is brand new and yours’ is already contradicted.

But what really makes me laugh is his boast that he will file a claim against people who make fraudulent disputes. Lets hear people who know the law chip in and correct me if I’m wrong.

A Corsair like that, maybe sells for $80.

Court fees for filing a complaint, $58.

Service by registered mail, $25 more?

Depending on his jurisdiction, many small claims courts do not accept claims where the damage is too small. Akron seems to have no lower limit, unfortunately for the bad folks who want to screw over this seller.

To win court costs you need a convincing case. In a he said, she said, civil suit where judgement is rendered on 51% likelihood of one side being truthful, the judge won’t be awarding costs.

And what if buyer resides outside jurisdiction of Akron, Ohio? Seller thinks he can file against a defendant residing outside, and win judgement by default?

And how is seller going to get judgement enforced?

Can’t he just quietly specify no low feedback people, like many sellers do? Why must he pump out all that nasty sounding blurb to make himself sound like a tough guy?

As a guy who has done over 800 transactions under my ebay accounts in the past, I have never come across a seller who, in his very description, actually makes me want to file a scamious false complaint against!

Most of the modding can be done on your own once you break through the psychological barriers.
