Poker 3 Backlit Caps Lock question

Hi everyone. New member here. Just got a Poker 3 with white led backlighting and MX clears.

I have the DIP switch set to use the caps lock as a FN key. Everytime I reboot the computer, the LED for the caps lock turns OFF. For it to turn back on, I have to hit FN-X and recycle the modes and it will then be lit. If I unplug the usb or reboot the system, caps lock LED goes off again. This is driving me nuts!

I've googled this and searched this forum for an answer but cannot find it. Anyone else have this issue? Is this normal or is this a defect?

EDIT:
Using the latest BIOS and have tried toggling the DIP switch with the caps lock enabled and then flipping it back as a FN key - all nogo.

The CAPS LOCK key remains functional while in the fade in/fad out breathe mode.

I found this post from January which suggests that a new firmware will fix the (known) issue.

I have no idea if a new firmware was subsequently released.

Yeah, unfortunately the latest firmware still does this.

Can anyone with a backlit Poker 3 please confirm that theirs is doing this as well? Just so I know it is not an isolated issue with my copy.

I have gotten the latest firmware update and it fixed the annoying humming of the lights, but the capslock light still remains dark unless you cycle through the modes. 

I have something else you can try, not really related.  I can't get anybody else to confirm this....  Press Fn (CapsLock) +LCtrl + Win, then press LCtrl repeatedly and see if you can toggle through some new modes, one being a dancing light and the other being the illumination only of the "3" digit.
